These Terms of Service (“Terms”) govern your use of FixMyTires (“we,” “us,” or “our”) services, including services requested or booked through our website, by phone, online booking, or through any other communication channel.

By requesting, booking, purchasing, or using our mobile tire services, you agree to these Terms.

1.Services

FixMyTires provides mobile tire-related services, including tire installation, flat tire repair, tire replacement, tire rotation and balancing, new and used tire sales, tire fitting, and other related mobile tire services.

Service availability, response times, appointment availability, tire availability, and pricing may vary depending on your location, vehicle, tire requirements, weather conditions, technician availability, and other circumstances.

We reserve the right to decline or discontinue a service if our technician determines that the requested work cannot be completed safely or properly.

2.Booking and Customer Information

When requesting or booking a service, you agree to provide accurate, complete, and current information.

This information may include:

  • Your name and contact information.
  • Vehicle make, model, and year.
  • Tire size and specifications.
  • Service location.
  • Requested appointment date and time.
  • Type of tire service required.
  • Details regarding damaged or flat tires.

Incorrect or incomplete information may result in delays, rescheduling, additional charges, or our inability to complete the requested service.

3.Pricing, Fees, and Payment

Pricing may vary depending on the requested service, tire type, vehicle type, service location, travel distance, labour requirements, parts, materials, and any additional work requested.

Additional charges may apply for:

  • Additional tire repairs or replacements.
  • Additional labour.
  • Special or oversized tires.
  • Extended service areas or additional travel.
  • Emergency or after-hours service.
  • Additional parts or materials.
  • Additional services requested during the appointment.

Payment is due according to the terms provided at the time of booking or service. FixMyTires may require a deposit, partial payment, or full payment before an appointment.

If a payment is declined or cannot be processed, we may cancel, suspend, or refuse the service.

4.Cancellations, Rescheduling, and No-Shows

Appointments may be cancelled or rescheduled by contacting FixMyTires.

Except where applicable law provides otherwise, cancellations made within 72 hours of the scheduled appointment may be non-refundable or subject to a cancellation fee.

If a customer is unavailable when the technician arrives at the confirmed service location, the appointment may be considered a no-show, and some or all of the scheduled service charges may still apply.

If FixMyTires needs to cancel or reschedule an appointment, we will make reasonable efforts to notify the customer and arrange another suitable appointment time.

5.Arrival Times and Delays

Appointment and arrival times are estimates unless specifically confirmed otherwise.

Traffic, weather, road conditions, accidents, emergencies, previous service appointments, equipment issues, and other circumstances outside our reasonable control may cause delays.

FixMyTires is not responsible for delays caused by circumstances outside our reasonable control.

If a significant delay occurs, we will make reasonable efforts to keep you informed using the contact information provided with your booking.

6.Safe Service Location and Customer Responsibilities

Because FixMyTires provides mobile tire services, customers are responsible for providing a safe and reasonably accessible location where the requested work can be performed.

Our technicians may refuse or discontinue work where conditions are considered unsafe, including:

  • Dangerous roadside locations.
  • Unsafe traffic conditions.
  • Insufficient working space.
  • Unstable or uneven surfaces.
  • Severe weather conditions.
  • Hazardous surroundings.
  • Unsafe or inaccessible vehicles.

Customers are also responsible for providing reasonable access to the vehicle and any necessary equipment or information, including vehicle keys, wheel-lock keys or adapters, and accurate tire information.

7.Tires, Wheels, Vehicle Condition, and Additional Work

Our technicians may inspect tires, wheels, wheel studs, lug nuts, tire-pressure monitoring systems, and other relevant components before performing a service.

We may refuse to repair, install, or continue using a tire or wheel that we reasonably believe is unsafe, excessively damaged, unsuitable for the vehicle, or incapable of being safely repaired.

Customers should inform FixMyTires of any known tire, wheel, suspension, wheel stud, lug nut, or related vehicle damage before service begins.

FixMyTires is not responsible for pre-existing damage or defects that existed before our technician began the service.

Additional work or services requested or required after inspection may result in additional charges. Where reasonably possible, we will notify you before significant additional work is completed.

8.Customer Conduct and Service Refusal

Customers must behave respectfully and provide a safe working environment for FixMyTires technicians and representatives.

We reserve the right to refuse or discontinue service in cases involving:

  • Threatening or abusive behaviour.
  • Harassment.
  • Unsafe conduct.
  • Illegal activity.
  • Interference with the technician’s work.
  • Any material safety concern.

Where service is discontinued due to customer conduct or unsafe conditions, charges may still apply for travel, inspection, labour, parts, or work already completed.

9.Liability, Privacy, and Intellectual Property

To the maximum extent permitted by applicable law, FixMyTires will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from the use of our services.

We are not responsible for losses resulting from circumstances outside our reasonable control, including traffic, severe weather, road closures, vehicle defects, undisclosed pre-existing damage, or inaccurate information provided by the customer.

To the maximum extent permitted by applicable law, our total liability for a claim relating to a specific service will not exceed the amount paid by the customer for the service giving rise to that claim.

Customers are responsible for personal belongings left in or around their vehicles during service.

Our collection, use, storage, and protection of personal information are described in our Privacy Policy.

All FixMyTires website content, branding, logos, graphics, photographs, service descriptions, designs, and other materials are owned by FixMyTires or its applicable licensors and may not be copied, reproduced, distributed, or commercially used without permission.

10.Governing Law and Changes to These Terms

These Terms are governed by and interpreted according to the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights available under applicable law, disputes relating to these Terms or FixMyTires services will be resolved by courts having jurisdiction in Ontario, Canada.

Nothing in these Terms limits any consumer rights or legal remedies that cannot be waived under applicable law.

FixMyTires may update these Terms from time to time to reflect changes in our services, business practices, technology, or applicable requirements.

Any updated Terms will be posted on our website.
